PRIVACY POLICY

Pursuant to Regulation (EU) no. 2016/679 (hereinafter, “GDPR”) and Leg. Decree no. 196/2003, as amended by Leg. Decree no. 101/2018, N.C.M. Sas - 8/d, Via Unità di Italia - 28100 Novara (NO) - Italy – VAT code no. 01152320030, as Data Controller (hereinafter, the “Data Controller”), does hereby inform you that your data shall be processed with the following method and for the following purposes:

1. Scope of Data Processing: the Data Controller shall process the personal and identification data (such as name, surname, company name, permanent address, telephone number and e-mail address, hereinafter, the “personal data” or “data”) provided by the Customer or directly collected by the Controller’s personnel to execute supply orders and/or equipment lease agreements, or generally within the scope of the provision of our products/services.

2. Purposes of Data Processing: personal data shall be processed without the data subject’s express consent (Art. 6 para. b) of GDPR) with a view to the handling and finalization of agreements, performance of activities arising from contract or legal obligations, the fulfilment of accounting and tax requirements, compliance with EC standards or regulations, or the exercise of the Data Controller or processor’s rights, such as the right to defend our case in a Law Court.

3. Methods of Data Processing, Data Retention Period: personal data are processed by means of the operations set forth in Art. 4 sub. 2) of the GDPR, and specifically: collection, recording, arrangement, storage, reference, processing, modification, selection, extraction, comparison, use, interconnection, blockage, communication, deletion and destruction of data. Personal data processing will be performed by electronic or automated procedures, or by means of a hard copy thereof. The Data Controller shall process all personal data for the period required to attain the aforesaid purposes and, in any case, no longer than 10 years from the termination of the contract for mandatory accounting and tax purposes. Should the finalization of agreements require the collection and processing of any personal data outside the scope of the fulfilment of administrative and accounting obligation arising therefrom, the said personal data shall be retained for a period of 5 years at the most, and then deleted and/or destroyed. 

4. Data Recipients: for the purposes heretofore set forth in para. 2, your personal data may be accessed and processed by the Data Controller’s personnel and contractors in their capacity as data processing operators and/or data processors or system administrators, as well as any companies or entities (such as accountants or labour consultants and the like) providing outsourcing services on behalf of the Data Controller in their capacity as independent data processors.

5. Data Communication: for the purposes heretofore set forth in para. 2, the Data Controller may communicate your data with no need for your express consent if disclosure of the said data to certain entities is legally mandatory for the fulfilment of specifically established requirements. The aforesaid entities shall process the data in their capacity as independent Data Processors or Controllers.

6. Data Transfer: your personal data are stored on servers located within the European Union. However, it is understood that, if so required, the Controller shall have the authority to move the servers to non-EU countries as well. In this case, the Controller shall henceforth ensure that the data will be transferred outside the EU in compliance with the applicable law provisions and following the agreement upon the standard contract clauses requested by the European Commission.

7. Rights of the Data Subject: in your position as data subject you can exercise the rights provided for by Art. 15 and, where applicable, Articles 16-21 of GDPR (right to amendment, cancellation, restriction of processing, data portability and opposition). Furthermore, you shall be entitled to submit a complaint to a supervisory authority. You can exercise your rights at any time by applying to the Data Controller by registered mail, return receipt requested, or sending an e-mail to info@enneciemme.it.

8. Data Controller, Processor and Data Processing Operators: An updated list of in-house and independent data processors is stored at the Data Controller’s registered office.

What are cookies?

Cookies are small pieces of text, usually just letters and numbers, sent to your device by your web browser by a website you visit.
